Terms and conditions

General

Please make sure that you have a good look at our but most importantly please note the following:.

  • We advise you to wear whatever you feel comfortable in along with sturdy footwear such as trainers or outdoor boots. Skirts, sandals and ‘Crocs’ are not permitted.  Always dress for the weather – we do have shelters onsite but please ensure that you have waterproof clothes if rain is forecast.

  • Please get here on time and allow 10 minutes for parking.  The essential Safety Briefing is always at the start of the session (apart from Open Access/Fun Day sessions – if you are late for this briefing without good reason then we may have to ask you to come back at another time.

  • The car park is governed by South Staffordshire Council and operates on a pay and display system.  Challenge Academy will not be held responsible for any parking charges/fines incurred whilst using the facilities they offer.

  • You and your guests will carry out the activity in accordance with the specific safety instructions given on the day.  All activity is instructor supervised and very safe, participants are always secure when at height, but we expect participants to take a level of personal responsibility for their wellbeing.

  • You and your guests accept that there is a risk of injury when undertaking adventurous activities and acknowledge that, in the unlikely event of an accident, or loss or damage to personal effects, Challenge Academy will not be liable for any direct or indirect loss, damage or injury arising from, or in connection with the activity, except if caused by the Company’s negligence.

  • You confirm that you will make staff aware of any medical conditions or specific needs that might have an adverse affect on you and your guest’s ability to complete the task safely.  

  • Challenge Academy reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should it deem it necessary to do so. This includes a participant who does not comply with the safety rules, does not obey instructions or who is deemed to be under the influence of alcohol or drugs.

  • All participants are required to act responsibly and courteously at all times and to respect other participants. Challenge Academy shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behaviour of any participant unsuitable.

Cancellation Policy  

Challenge Academy has the following cancellation policy:

  • For Public Bookings: on booking with us you can choose just to pay a 20% non-returnable deposit - the balance must be paid at a minimum of 72 hrs in advance. If payment is late without good reason then we reserve the right to cancel your booking with immediate effect.  

  • For bookings by organisations (schools, colleges, businesses): You must pay your full balance no later than 28 days in advance of your activity date. If payment is late without good reason then we reserve the right to cancel your booking with immediate effect.  Within the 28 day period no refunds can be made if numbers are reduced - numbers can be increased if suitable advance notice is given. If you make a new booking within the 28 day period then the terms of your invoice will be 'payment on return'.

  • If the Service cannot be delivered due to circumstances beyond the control of Challenge Academy, then we have no liability to make any payments to the party booker or refund any part of the booking. We will always offer alternative date options for your booking without additional charges.

  • The Activities will remain open in most weather conditions (but not in circumstances of gales, lightning, heavy ice or snow (at the discretion of the Lead Instructor).

  • No refunds or compensation will be payable by Challenge Academy in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities

  • If it proves necessary to close the Activities for reasons beyond the control of Challenge Academy and in circumstances where your party has commenced participation in the Activities; you shall not be entitled to any refund (in part or in whole). In such circumstances Challenge Academy may, but shall not be obliged to, offer alternative dates or times at reduced rates. it shall use its reasonable endeavours to notify you as soon as possible, no other compensation shall be payable.

  • Whilst every effort is made by Challenge Academy to carry out the activity in accordance with the booking, CA retains the right to postpone or change the booking or nature of the activity if this is necessary due to circumstances beyond its control, including but not limited to adverse weather conditions or unavailability of suitable staff, equipment. In such circumstances Challenge Academy will notify the party booker as soon as reasonably practicable of such changes and suitable arrangements will be made to postpone the event.

Challenge Academy Authority

The group booker agrees on its own behalf and on behalf of each and every party member:

  • To comply with any request or order made by Challenge Academy in the interests of safety howsoever expressed and to comply with any reasonable instruction given by Challeneg Academy for any other reason.  

  • That Challenge Academy reserves the right to request any party member to leave or be removed/rescued if in the opinion of Challenge Academy the party member is behaving in a dangerous, unreasonable or disruptive manner and the booker agrees to procure that such request will be complied with by each and every party member. In such circumstances Challenge Academy will be under no liability to the group booker or the party member in respect of any refund of the booking or compensation for any costs or damage which may be incurred by the party booker or the party member.

  • There must be at least 1 adult participating (or observing) to every 16 children (under 18) on the course.

Liability of the Booker for Damage

The party booker agrees that in the event of damage being caused to any facilities (including buildings and fixtures and fittings, vehicles or equipment) then the  group booker will be liable for the facilities and each and every vehicle or piece of equipment so damaged as follows

  • If the damage arises out of any act or omission of the party booker or any party member the party booker shall be liable for the first £300.00 on each and every item.

  • If the cause of the damage were deliberate the party booker shall be liable for all of the damages so caused or the full replacement values of each and every item.

Liability of Challenge Academy for Damage

  • Challenge Academy agrees to exercise all reasonable skill and care.

  • Challenge Academy has no liability to the Group booker or any guest. You and your guests accept that there is a risk of injury when undertaking adventurous activities and acknowledge that, in the unlikely event of an accident, or loss or damage to personal effects, Challenge Academy will not be liable for any direct or indirect loss, damage or injury arising from, or in connection with the activity, except if directly caused by the Company’s negligence.
